This website is operated by INFIART (, "we", "us", "our"). By visiting our Site or purchasing from us, you agree to these Terms of Service ("Terms"). Please read them together with our Privacy Policy, Return and Refund Policy, and Intellectual Property Policy.
SECTION 1 - ELIGIBILITY AND ACCEPTABLE USE
By agreeing to these Terms, you represent that you are at least 18 years of age, or the age of majority in your state, province, or country of residence, whichever is higher. You may not use our products or Services for any illegal or unauthorized purpose, and you must not transmit any viruses or code of a destructive nature. A breach of these Terms results in immediate termination of your access to the Services.
SECTION 2 - GENERAL CONDITIONS AND SECURITY
We reserve the right to refuse service to anyone for any reason at any time. All payment information is encrypted during transmission using industry-standard SSL/TLS technology, and we maintain appropriate technical and organizational measures to protect your data as described in our Privacy Policy. You agree not to reproduce, duplicate, copy, sell, or resell any portion of the Service without our express written permission.
SECTION 3 - INFORMATION, PRICES AND MODIFICATIONS
We take care to keep product information accurate; however, we do not warrant that all information on the Site is complete or current at all times. Colors are displayed as accurately as possible, but we cannot guarantee that your screen's display of any color will be accurate. Prices are subject to change without notice, and we reserve the right to modify or discontinue any product or the Service at any time.
SECTION 4 - ORDERS, CANCELLATION AND MODIFICATION
When you place an order, it constitutes an offer to purchase. We may accept or decline any order at our sole discretion, including to limit quantities or prevent fraud. You may request to cancel or modify an order by contacting support@infiart.com as soon as possible; we will accommodate such requests where the order has not yet entered fulfillment or shipment. Once an order has shipped, cancellations are handled under our Return and Refund Policy.
SECTION 5 - PRODUCTS AND WARRANTY
Certain products are available exclusively online. Our 6-Month Warranty (described in our Return and Refund Policy) is a commercial guarantee provided in addition to, and not in place of, your statutory rights, including where applicable the two-year legal guarantee of conformity under EU Directive 2019/771/EU and any other mandatory consumer rights in your country of residence.
SECTION 6 - USER COMMENTS AND SUBMISSIONS
If you send us ideas, suggestions, reviews, or other materials ("comments"), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and publish such comments for the purposes of operating and promoting the Services. We will not disclose your full name or contact details in connection with your comments without your consent, except as required by law. You represent that your comments do not violate any third-party rights or applicable law. We may remove content that is unlawful, offensive, or infringing.
SECTION 7 - PROHIBITED USES
You may not use the Site or its content: (a) for any unlawful purpose; (b) to infringe our or any third party's intellectual property rights; (c) to harass, abuse, or discriminate; (d) to submit false or misleading information; (e) to upload viruses or malicious code; (f) to collect or track personal information of others; (g) to spam, phish, scrape, or crawl the Site; or (h) to interfere with or circumvent the security features of the Site. We reserve the right to terminate access for any violation.
SECTION 8 - THIRD-PARTY TOOLS AND LINKS
We may provide access to third-party tools, links, or services (including payment processors and social media platforms) "as is" and without warranty. We are not responsible for the content, terms, or practices of third-party websites or tools. Please review their policies before use.
SECTION 9 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
The Service is provided "as is" and "as available" without warranties of any kind, except for the express warranties stated in our Return and Refund Policy and except for mandatory statutory rights that cannot be excluded. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including for death, personal injury caused by negligence, or fraud. To the maximum extent permitted by law, INFIART shall not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data. In all cases, our total liability shall not exceed the amount you paid for the products giving rise to the claim.
SECTION 10 - EU CONSUMER RIGHTS; ADR AND ODR
If you are a consumer residing in the European Economic Area or the United Kingdom: (a) you retain the mandatory consumer protections of your country of residence, including the 14-day right of withdrawal and the statutory guarantee of conformity, which these Terms do not limit; (b) the European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/; we are not currently committed to participate in alternative dispute resolution (ADR) schemes, but you may always contact us at support@infiart.com to resolve any issue directly.
SECTION 11 - GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law principles. However, if you are a consumer, nothing in this Section deprives you of the protection afforded to you by mandatory provisions of the law of the country where you have your habitual residence (Art. 6(2) Regulation (EC) No 593/2008). To the extent permitted by applicable law, disputes shall be subject to the jurisdiction of the competent courts of Wenzhou, China; however, if you are a consumer, you may also bring proceedings in the courts of the country where you reside, and we may bring proceedings against you only in the courts of your country of residence where mandatory law so requires.
SECTION 12 - ARBITRATION (US RESIDENTS ONLY)
To the maximum extent permitted by applicable law, and only for residents of the United States where enforceable: any dispute arising out of these Terms that is not resolved informally shall be settled by binding individual arbitration, and you waive any right to participate in a class or representative action. This Section does not apply where prohibited by law and does not apply to consumers residing in the EEA or the UK, who retain their rights under Section 11.
SECTION 13 - SEVERABILITY; ENTIRE AGREEMENT; CHANGES
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, Return and Refund Policy, and IP Policy, constitute the entire agreement between you and us. We may update these Terms by posting revisions on this page; your continued use of the Site constitutes acceptance.
