At INFIART, we respect the intellectual property rights of others and take the protection of our own creative works and designs equally seriously.
1. INFIART Intellectual Property
All content, features, and functionality on this website and our products are the exclusive property of INFIART or its licensors, protected by international copyright, trademark, patent, and other intellectual property laws, including:
Trademarks: the INFIART name, logo, and related marks;
Design rights: the industrial designs, shapes, and structures of our markers and art supplies (backed by 200+ granted patents);
Copyrighted content: product photography, color swatch charts, videos, website copy, and graphic designs.
You may not reproduce, distribute, modify, display, or commercially exploit any INFIART intellectual property without our express written consent, including using our color swatches or product images in unauthorized commercial advertising or third-party marketplace listings.
2. Respect for Third-Party Rights
We maintain a strict policy against counterfeit and infringing products, and we proactively review our product lines and Site content to prevent infringement of valid third-party trademarks, patents, and copyrights.
3. Notice of Claimed Infringement
For copyright claims, we process notices in accordance with the DMCA (17 U.S.C. §512); for trademark and patent claims, we apply the same procedure as a voluntary policy. If you believe that any content on our Site or any product we sell infringes your intellectual property rights, please send a written notice to our designated agent containing:
(a) identification of the copyrighted work, trademark, or patent claimed to be infringed;
(b) identification of the material or product claimed to be infringing, with sufficient information (e.g., the URL) to allow us to locate it;
(c) your contact information, including name, address, telephone number, and email address;
(d) a statement that you have a good-faith belief that the disputed use is not authorized by the rights owner, its agent, or the law;
(e) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner of the exclusive right being infringed or are authorized to act on the owner's behalf; and
(f) your physical or electronic signature.
4. Response Time and Actions
We will acknowledge and begin reviewing a valid notice within 5–10 business days of receipt. If a claim is substantiated, we may remove or disable access to the infringing content, cease sale of the product, destroy infringing inventory in our possession, and/or suspend relationships with responsible parties. Where contact details are available, we will notify the party that posted or supplied the material.
5. Counter-Notice
If you believe that material you posted or supplied was removed or disabled by mistake or misidentification, you may send a counter-notice to our designated agent containing: (a) identification of the removed material and its former location; (b) a statement, under penalty of perjury, that you have a good-faith belief the removal was a mistake or misidentification; (c) your name, address, and telephone number, and your consent to the jurisdiction of the courts in which our designated agent is located; and (d) your physical or electronic signature. Upon receipt of a valid counter-notice, we may restore the material within 10–14 business days unless the complainant initiates legal action, as permitted under 17 U.S.C. §512(g).
6. Repeat Infringer Policy
In appropriate circumstances, we will terminate the accounts of, or refuse further service to, users or suppliers who repeatedly infringe the intellectual property rights of others.
